These Terms of Use (the "Terms") apply between the user and the Cala mobile application (formerly known as Kıyı Rehberi) (the "App") operated by Yunus Emre Tugay. By downloading, signing up for or using the App you are deemed to have accepted these Terms.
The App is a guide service providing location, amenity and price information for beaches and coves along the coasts of Türkiye, the Greek islands, Spain, Portugal, France, Italy, Croatia and Albania, shelter assessments based on current wind conditions, crowd estimates and user-submitted crowd reports; it also lets users share cove reviews (rating, comment and photos) and create public profiles.
The wind, shelter and crowd information in the App is of an estimative nature and is not guaranteed. Wind assessments are produced from third-party weather data and generalized calculations; crowd information is produced from statistical estimates and user reports whose accuracy is not verified.
Do not base your safety decisions regarding swimming, boating, diving and similar activities solely on the information in the App. Always rely on official meteorological warnings, lifeguard and flag signals and the conditions on site. To the maximum extent permitted by law, no liability is accepted for direct or indirect damages that may arise from the use of the App.
Beach information (fees, amenities, operating status) may change over time; its currency is not guaranteed.
Some features (favorites, Premium) require an account. You are responsible for the accuracy and confidentiality of your account information. You can delete your account within the App at any time.
Some features of the App (including "Sahil Pusulası" / Coast Compass) are subject to paid Premium access. All purchases are made through the Apple App Store, tied to your Apple ID.
Prices are shown on the purchase screen and may vary by region. Refunds are subject to Apple's refund policy and are requested through Apple. Your Premium access is tied to your account; you can continue your access on a new device by signing in with the same account.
Right of withdrawal: The Premium subscription is a service performed instantly in an electronic environment. Pursuant to subparagraph (ğ) of the first paragraph of Article 15 of the Turkish Distance Contracts Regulation, consumers have no right of withdrawal in contracts for services performed instantly in an electronic environment. As your Premium access is activated immediately upon purchase and performance of the service begins immediately with your approval, you cannot exercise a right of withdrawal under this exception. Refund processes for purchases made through the Apple App Store are additionally subject to Apple's policies.
When submitting crowd reports you agree not to make submissions that do not reflect reality, are systematically misleading or are intended to disrupt the service. If abuse is detected, the relevant reports may be removed and the ability to submit may be restricted.
You may submit cove suggestions, cove reviews (rating and comment), photos, descriptions, change requests or reports to the App, and share a display name, username, profile photo and "about" text on your public profile (together, "User Content"). By uploading User Content you grant us a worldwide, free of charge, perpetual and sublicensable right to publish, reproduce, adapt and display that content within the App and in the promotion of the App. You retain ownership of the content; after the content is removed from the App this license continues only for a reasonable period for backup and record-keeping purposes.
If approved, your reviews are displayed publicly within the App together with your display name, username and profile photo. You can delete your reviews at any time; when you delete your account, your reviews, photos and public profile are deleted as well.
You represent and warrant that the content you submit belongs to you or that you have the right to share it, and that it does not infringe the rights of third parties, including copyright, trademark, personality rights and the right to privacy. If photographs contain identifiable persons, you declare that you have obtained those persons' consent to the publication of their images. You agree not to submit unlawful, misleading, defamatory or obscene content. Responsibility arising from User Content lies with the submitting user.
All submitted User Content is subject to review before publication. We reserve the right to publish or not publish, edit, shorten, reject or remove content at any time without prior notice. Users who violate these Terms may have their ability to submit content restricted or their accounts closed.
Community guidelines: The following are prohibited in your reviews, photos and profile content:
You can report inappropriate content using the report option next to the relevant content ("Report this review" / "Report content") or by writing to emre@pimrobotics.com. Reports are reviewed within a reasonable time and content deemed necessary is removed. You can also block any user; a blocked user's content is not shown on your device and you can unblock them at any time.
A one-time gift of 1 month of Premium access may be granted for the first approved cove suggestion. Granting of the reward depends on our review and approval of the suggestion; not every suggestion will be published or earn a reward, and the decision is at our discretion. We reserve the right to change, suspend or terminate this reward program at any time; in the event of abuse (fake, duplicate or misleading suggestions) the reward may be withheld or revoked. The reward has no cash value and is non-transferable. This campaign is not sponsored, operated by, or associated with Apple in any way.
If you notify us that you are the operator of a beach or cove listing or suggest changes to listing information, your request is subject to a verification process; additional documents or information may be requested from you if deemed necessary. Submitting a request does not create any right, authority or guarantee of change over the relevant listing. Whether to accept requests is at our discretion and the outcome may be communicated via the contact details you provided in the form.
The design, software and original content of the App belong to Yunus Emre Tugay. Part of the beach location and attribute data is derived from © OpenStreetMap contributors data (ODbL license); bathing water quality data comes from the European Environment Agency (EEA) "Status of bathing water" dataset (CC BY 4.0), Spain beach information from the open data of the Ministerio para la Transición Ecológica y el Reto Demográfico (MITECO), Portugal beach information from the open data of the Agência Portuguesa do Ambiente (APA) (CC BY 4.0; current status and alerts are verified via APA's InfoÁgua service), France beach and bathing water information from the open data of the Ministère chargé de la Santé (data.gouv.fr; Licence Ouverte / Open Licence) and surface/setting/access information from the DATAtourisme national tourism database (Licence Ouverte 2.0), Italy beach profile information from the Ministero della Salute "Portale Acque" portal (CC BY 3.0 IT), and Croatia beach profile information is compiled from the national bathing water portal of the Ministarstvo zaštite okoliša i zelene tranzicije / IZOR; Natural Earth (public domain) is used for coastal derivations. Weather data is provided by Open-Meteo. Detailed source and license information is available on the "Licenses" screen in the App.
The App's features may be improved, changed or discontinued with reasonable notice. These Terms may be updated; the current version is published on this page and significant changes are announced within the App.
These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of İzmir have jurisdiction over disputes. The rights of users qualifying as consumers to apply to consumer arbitration committees and consumer courts under applicable legislation are reserved.
